Expected Activities: Gnosis Wellness Collective and its facilitators are organizing a retreat to El Paredón, Guatemala. Each participant is expected to cover the cost of his or her plane ticket and the cost of the selected retreat package. The retreat includes lodging, transportation to and from the airport (if certain requirements are met), meals as outlined in the retreat package, and retreat programming facilitated or coordinated by the organizers. Retreat programming and activities may include somatic coaching, surf instruction, yoga, breathwork, group experiences, excursions, and other wellness-related offerings. ___________

Voluntary Participation: I fully understand and acknowledge that I am under no compulsion to participate in any of the activities and that my attendance at the retreat and participation in any of the activities are fully voluntary. I have been advised that I may, at any time, decide not to participate in the retreat or any or all of the Activities without any penalty or adverse effect to me. I understand that deposits are non-refundable. I further agree that no refunds of any amount will be issued to individuals who cancel less than 14 days before the start of the retreat. I’ve been advised that access to medical care in El Paredón and the surrounding areas is limited, and that emergency medical services may be delayed or unavailable. Despite this information, I agree to participate in this retreat voluntarily. ___________

Acknowledgment of Risks: I fully understand and acknowledge that the retreat and the Activities involve inherent risks, dangers, and hazards; that my participation in the outing and the activities may result in injury or illness including, but not limited to bodily injury, death, other disability, or injury or damage to my personal property; and that these risks may be caused by the negligence of the Released Persons (defined below).
Ocean and Physical Activity Risks: I understand and acknowledge that certain retreat activities may take place in or near the ocean and may include surfing, swimming, boating, or other water-related activities. I understand that ocean conditions can be unpredictable and may involve hazards including waves, rip currents, marine life, changing weather, and other natural conditions. I further understand that physical activities offered during the retreat, including but not limited to surfing, yoga, breathwork, movement practices, and excursions, may involve physical exertion and inherent risks. I voluntarily assume all risks associated with participating in these activities, whether supervised or unsupervised. ___________

International Travel Acknowledgment: I understand that this retreat takes place outside of the United States and that international travel may involve additional risks including but not limited to transportation delays, unfamiliar environments, different standards of medical care, political or environmental conditions, and other circumstances beyond the control of the retreat organizers. I voluntarily assume all risks associated with international travel and participation in activities taking place in a foreign country. ___________

Waiver and Release: I grant and sign this Waiver of Liability and Release voluntarily and in full recognition and appreciation of the dangers and risks inherent in my participation in the retreat and the Activities. ON BEHALF OF MYSELF, MY HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, I DO HEREBY WAIVE AND EXTINGUISH, AND FOREVER RELEASE AND ACQUIT THE RELEASED PERSONS FROM all claims, demands, rights, and causes of action of whatever kind or nature that I have or may have against any of the Released Persons arising from and by reason of any and all known, unknown, foreseen, and unforeseen bodily and personal injuries, damage to property, and all consequences thereof, resulting from my involvement or participation in the Activities and any other programs, activities, or events in connection with the retreat described above, including without limitation any such claims, demands, rights, or causes of action resulting from the negligence of any Released Person. I hereby agree that under no circumstances will I or my heirs, executors, administrators, or assigns prosecute or in any way whatsoever present any claim for personal injury, property damage, or wrongful death occurring to me against any Released Person for any of the said causes of action, whether the same shall arise by negligence of any of the Released Persons or otherwise. In the event that any such claim is made against a Released Person by me, my heirs, executors, administrators, or assigns for personal injury, property damage, or wrongful death occurring to me during the outing, I agree, on behalf of myself and my heirs, executors, administrators and assigns, to indemnify and save harmless the Released Person(s) from any and all such claims or causes of action. ___________

I recognize that this Waiver and Release of Liability means I am giving up, among other things, rights to sue any and all Released Persons, and it is my voluntary intent to do so. I also understand that this Waiver and Release of Liability binds my heirs, executors, administrators and assigns, as well as myself. ___________

Costs and Indemnity: In the event of an accident, injury, illness, or any other emergency, I acknowledge that I am solely responsible for all medical and other costs arising out of bodily injury or loss that I sustain through my involvement in the above-referenced program. Further, I hereby authorize the retreat organizers to secure any licensed hospital, physician, and/or medical personnel to render all treatment deemed necessary for my immediate care. ___________

Right of Publicity: In addition, for valuable consideration, I hereby give to Gnosis Wellness Collective and its facilitators the absolute and irrevocable right and permission with respect to photographs that any of them take or have taken of me during the course of the retreat and the Activities to use, re-use, publish, and republish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising, and trade. I hereby release and discharge the photographer of any such photographs from any and all claims and demands ensuing from or in connection with the use of the photograph, including any and all claims for libel and invasion of privacy. This authorization and release shall insure to the benefit of the legal representatives, licensees, and assigns of the photographer as well as the person(s) for whom the photographer took the photographs. ___________

Choice of Law, Forum, Severability: I understand and agree that any and all issues of law related to the retreat, the Activities, my participation in the outing and the Activities, and this Waiver and Release of Liability will be determined under and in accordance with the laws of the State of South Carolina (other than any conflict-of-laws provisions thereof); that any such determination will be made in State or federal court located in Charleston, South Carolina; and that in the event that any portion of this Waiver and Release of Liability is determined to be unenforceable, the remainder hereof shall survive and be enforceable in accordance with its terms. ___________
I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE EACH AND ALL OF THE RELEASED PERSONS IDENTIFIED ABOVE FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH OCCURRING TO ME CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

Retreat Terms & Conditions & Cancellation Policy

Reservations
A reservation is confirmed once payment has been received. Retreat spaces, rooms, and beds are limited and are reserved on a first-come, first-served basis. Because retreat capacity is limited and accommodations must be secured in advance, all bookings are subject to the cancellation terms outlined in this policy.

Deposits
A deposit is required to reserve a retreat space. Deposits are non-refundable, except in the event that the retreat is canceled by the organizers. The deposit secures the participant’s place in the retreat and allows the organizers to commit to accommodations, instructors, transportation, and other retreat expenses.

Payment Options and Payment Plans
Participants may reserve their retreat space using one of the following payment options available at checkout:

• Pay in Full – the full retreat cost is paid at the time of booking.
• Deposit Option – a $1,200 non-refundable deposit is paid at booking to secure the participant’s space. The remaining balance will be divided into two scheduled payments due four (4) months before the retreat start date and sixty (60) days before the retreat start date.
• Three-Payment Plan – when available, the retreat cost may be divided into three scheduled payments beginning at booking, with remaining payments due four (4) months before the retreat and sixty (60) days before the retreat.
By selecting a deposit or installment plan, participants agree to complete all remaining payments according to the payment schedule established at the time of booking.
All retreat balances must be paid in full no later than sixty (60) days before the retreat start date.

Because retreat accommodations, instructors, transportation, and other services are reserved in advance, participants remain financially responsible for the full retreat cost once a reservation is confirmed. Failure to complete scheduled payments may result in cancellation of the reservation and forfeiture of any payments made.
Refund eligibility is governed solely by the Participant Cancellation terms outlined below.

Participant Cancellations
Refund eligibility is determined by the date the written cancellation notice is received by the organizers.
Because retreat expenses are committed well in advance, the following cancellation terms apply:
More than 90 days before the retreat start date
Payments made beyond the non-refundable deposit may be refunded.
60–90 days before the retreat start date
Up to 50% of the total retreat cost may be refunded.
Less than 60 days before the retreat start date
All payments are non-refundable.

These timelines apply regardless of the reason for cancellation, including illness, travel delays, work conflicts, family emergencies, or other personal circumstances. Refund eligibility is determined based on the date and time the written cancellation notice is received by the organizers.

Transfers
Participants who cannot attend may request to transfer their reservation to another participant.
Transfers must be approved by the retreat organizers and completed before the retreat start date.
The original participant is responsible for arranging any financial exchange related to the transfer.

Retreat Cancellation by Organizers
If the retreat is canceled by the organizers, participants will receive a full refund of all payments made, including deposits. The organizers are not responsible for additional expenses incurred by participants, including but not limited to airfare, travel costs, accommodations outside the retreat, or other personal expenses.
Retreat Postponement
If the retreat must be postponed due to circumstances beyond the organizers’ control—including but not limited to weather events, natural disasters, public health concerns, political conditions, travel disruptions, venue issues, illness of facilitators, or other circumstances affecting travel or participant safety—the organizers reserve the right to reschedule the retreat to a future date.

In the event of postponement, participants will have the option to:

• transfer their reservation to the rescheduled retreat dates, or
• apply their payments as credit toward a future retreat hosted by the organizers.
Postponement of the retreat does not constitute a cancellation, and refunds may not be issued unless the organizers determine that the retreat cannot be reasonably rescheduled.

Venue or Supplier Cancellation
Retreats depend on the availability of accommodations, transportation providers, instructors, and other third-party services. If the retreat venue or a critical supplier becomes unavailable due to circumstances beyond the organizers’ control, the organizers reserve the right to relocate the retreat to a comparable venue or modify elements of the retreat experience as reasonably necessary.

Such changes do not constitute grounds for cancellation or refund, provided the retreat program can still be reasonably delivered.

No-Show Policy
Participants who do not attend the retreat, arrive late, or leave early are not eligible for refunds or credits.
Travel Insurance Participants are strongly encouraged to purchase travel insurance that covers trip cancellation, interruption, medical expenses, and travel delays.
Travel insurance protects participants against financial loss caused by unexpected circumstances that prevent attendance.

Chargebacks and Payment Disputes
By submitting payment for the retreat, participants acknowledge that they have read and agree to this cancellation policy. Participants agree not to initiate chargebacks or payment disputes with their credit card company or payment provider in violation of the terms outlined in this policy. In the event of a payment dispute or chargeback, the organizers reserve the right to provide documentation of the agreed-upon terms and pursue recovery of disputed funds.

Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of South Carolina, United States, without regard to conflict of law principles.

Binding Agreement
By reserving a space in the retreat and submitting payment, participants acknowledge that they have read, understood, and agree to be bound by the terms and conditions outlined in this Retreat Cancellation Policy.
This policy forms part of the booking agreement between the participant and the retreat organizers and applies to all reservations, payments, and cancellations related to the retreat.
Participants confirm that they have had the opportunity to review this policy prior to completing their reservation.
